This policy is aligned with the Swiss Federal Act on Data Protection (revFADP, in force since September 2023) and the EU General Data Protection Regulation (GDPR).

2. Overview

Surviving Audio ("the App") is a field-reference toolkit for audio engineers (frequency / BPM / temperature / speed-of-sound conversions and related utilities). The App is designed privacy-first and runs on your device:

3. Data processed locally on your device

All calculations and inputs run entirely inside your device's browser or native WebView. User inputs (frequency values, BPM, temperature, the most recently active section) are persisted in the browser's localStorage so the App can restore state after a restart. This data never leaves your device and can be cleared at any time by clearing the App's storage or site data.

Legal basis: Legitimate interest (Art. 6(1)(f) GDPR / Art. 31(1) revFADP) in providing the basic functionality the user requests.

Retention: Until you clear the App's storage or uninstall the App.

4. Optional external services (GPS temperature lookup)

The App offers one optional feature that contacts external servers, and only when you explicitly tap the temperature field:

No account, cookie, session-ID or other user identifier is transmitted. Your IP address is necessarily visible to the receiving server as a technical side effect of any HTTPS request. Neither the App nor its author stores or logs these requests.

Legal basis: Consent (Art. 6(1)(a) GDPR / Art. 31(1) revFADP). Consent is given by explicitly tapping the temperature field and, if prompted, granting location permission. Consent can be revoked at any time by denying or revoking location permission in system settings.

International transfer (BigDataCloud, Australia): Australia is not covered by an EU adequacy decision. The transfer of a single GPS coordinate per explicit user tap takes place on the basis of Art. 49(1)(a) GDPR — the data subject's explicit consent, after being informed of the associated risks that arise from the absence of an adequacy decision and of appropriate safeguards. If you do not wish this transfer to take place, do not tap the temperature field.

Open-Meteo is based in Switzerland and therefore benefits from the adequacy recognition between Switzerland and the EU.

If you deny location permission or do not tap the temperature field, no external requests are made.

5. Permissions the App may request

Legal basis for GPS access: Consent (Art. 6(1)(a) GDPR / Art. 31(1) revFADP) via the operating system's permission prompt.

6. Hosting

The web version is hosted by Netlify, Inc. (44 Montgomery Street, Suite 300, San Francisco, CA 94104, USA). Netlify may keep technical server logs (IP address, user agent, timestamp) for up to 30 days for security and operational purposes.

Legal basis: Legitimate interest (Art. 6(1)(f) GDPR / Art. 31(1) revFADP) in secure and reliable operation.

International transfer: As Netlify is US-based, your IP address is transferred to the United States. Netlify participates in the EU-US and Swiss-US Data Privacy Frameworks, which are recognised as providing an adequate level of data protection. See netlify.com/privacy.

7. No Tracking or Analytics

No cookies (beyond strictly necessary functional ones, if any), trackers, analytics tools (Google Analytics, Firebase Analytics, Meta Pixel, etc.) or advertising services are used.

8. Children's Privacy

The App is a technical reference tool without social or commercial features. It does not knowingly collect personal information from any user, including children under 16 (GDPR Art. 8) or under 13 (US COPPA). If you believe a child has provided personal information to us, contact hello@soundtools.tech and we will delete it.
